Welcome to Seriously Pieceful! The terms "we," "us," and "our" refer to Seriously Pieceful, operated by NODS Group LLC, a limited liability company registered in Wyoming, United States. Seriously Pieceful operates this store and website at seriouslypieceful.com (the "Site"), including all related content, features, tools, products, and services, to give you, the customer, a curated shopping experience (the "Services"). Seriously Pieceful is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (these "Terms"), together with our Privacy Policy, describe your rights and responsibilities when you use the Services. Please read them carefully — they include important information about your legal rights, including warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use or access the Services.
1. Access and Eligibility
By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence, and that you have consented to any minor dependents using the Services on devices you own or manage.
To place an order, you may be asked to provide information such as your email address, billing, payment, and shipping details. You represent that all information you provide is correct, current, and complete, and that you have the right to provide it.
We do not currently offer customer accounts — orders are placed as guest checkout.
2. Our Products
We sell custom photo puzzles, made to order from images you upload. We've made every effort to accurately represent our products, but colors and appearance may vary depending on your screen and device settings, and we don't warrant that the finished product will look exactly as rendered on the Site.
Because our puzzles are personalized and made to order, the finished result depends directly on the quality, resolution, and content of the image you provide. Please review your uploaded photo and order details carefully before submitting.
Product descriptions are subject to change at any time without notice, and we reserve the right to discontinue any product or limit quantities at our discretion.
3. Orders and Acceptance
When you place an order, you're making an offer to purchase. We reserve the right to accept or decline any order for any reason, including if an item is unavailable, if we suspect fraud or error, or if the image or content violates these Terms. Your order isn't accepted until we confirm it and payment has been processed — please review your order carefully before submitting, as we may be unable to accommodate cancellation requests once production has started.
If we decline, change, or cancel an order, we'll attempt to notify you using the contact information provided at checkout, and refund any amount already paid for the cancelled item.
You represent that your purchase is for personal or household use, not for commercial resale.
4. Pricing and Payment
All prices are listed in United States Dollars (USD) unless stated otherwise, and do not include taxes, shipping, or applicable customs/import charges unless stated. Prices, discounts, and promotions may change at any time without notice, but changes won't affect orders already accepted. The price charged will be the price in effect at the time your order is placed, as shown in your order confirmation email.
You agree to provide accurate, current payment and billing information, and you represent that you're authorized to use the payment method provided and that charges will be honored by your payment provider. Payment is processed by our third-party payment providers — we do not store your full card details.
If a product is listed at an incorrect price due to a display or system error, we may cancel the affected order and issue a refund, even after the order was placed.
5. Shipping and Delivery
We ship worldwide. Estimated production and delivery times shown on the Site are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, weather, or other circumstances outside our reasonable control.
Once we transfer your order to the carrier, risk of loss passes to you. Please make sure your shipping address is correct at checkout — we are not responsible for orders delivered to an incorrect address you provided.
6. Returns, Refunds, and Our Reprint Guarantee
Because our puzzles are custom made from your photo, they can't be resold and are not eligible for change-of-mind returns, except where required by law.
Our reprint guarantee covers manufacturing defects and damage that occurs in transit. If your order arrives defective or damaged, contact us at hello@seriouslypieceful.com within 30 days of delivery, including a photo of the issue, and we'll arrange a reprint.
This guarantee does not cover dissatisfaction resulting from the quality of the image you uploaded — for example, low resolution, blur, or poor cropping. See our photo guide for tips on choosing a photo that will translate well into a puzzle.
7. Intellectual Property
Our Services — including our name, logo, branding, text, graphics, product designs, and site content (other than images you upload) — are owned by Seriously Pieceful, our affiliates, or licensors, and are protected by U.S. and international intellectual property law.
These Terms permit you to use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, publicly display, republish, or otherwise exploit any part of the Services without our prior written consent. All rights not expressly granted here are reserved.
Your uploaded photos: you retain full ownership of any image you upload. By uploading it, you grant us a limited license to use that image solely to produce, fulfill, and ship your order (see our Privacy Policy for how we handle and delete uploaded images). You represent and warrant that you own the rights to any image you upload, or have permission to use it, and that it doesn't infringe on anyone else's rights.
"Seriously Pieceful" and our logo are our trademarks. Shopify's name, logo, and related marks are trademarks of Shopify. All other trademarks on the Services belong to their respective owners.
8. Optional Third-Party Tools
We may give you access to tools provided by third parties that we don't control or monitor. These are provided "as is" and "as available," without warranties of any kind, and we have no liability arising from your use of them. Use of any optional third-party tool is at your own risk — review the relevant third party's own terms before using it.
9. Third-Party Links
The Services may contain links to websites operated by third parties. We don't examine or endorse third-party content, and we're not responsible for the accuracy, content, or practices of any third-party site. Visiting a linked site is at your own risk — review their policies before engaging in any transaction there.
10. Relationship with Shopify
Seriously Pieceful is powered by Shopify, which enables us to provide the Services to you. Any sales you make through our Site are made directly with Seriously Pieceful, not Shopify. Shopify is not responsible for any aspect of sales between you and us, including any injury, damage, or loss resulting from purchased products. You release Shopify and its affiliates from all claims, damages, and liabilities arising from your transactions with Seriously Pieceful.
11. Privacy Policy
All personal information collected through the Services is handled as described in our Privacy Policy, which forms part of these Terms. Because the Services are hosted by Shopify, some of your information is also processed by Shopify — see our Privacy Policy for details on how we, Shopify, and our service providers use your data.
12. Feedback
If you send us ideas, suggestions, reviews, or other feedback ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and publish that Feedback for any purpose, including commercial use. We're under no obligation to keep Feedback confidential, compensate you for it, or respond to it.
You represent that you own or have rights to any Feedback you submit, and that it won't violate any third party's rights or contain anything unlawful, abusive, or harmful (including malicious code).
13. Errors, Inaccuracies, and Omissions
The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, or availability. We reserve the right to correct these, and to change, update, or cancel orders based on inaccurate information, at any time and without prior notice — including after an order has been submitted.
14. Acceptable Use
You agree to use the Services only for lawful purposes. You may not use the Services to: violate any law; infringe our intellectual property or anyone else's; harass, defame, or harm any person; transmit false or misleading information; send spam or unsolicited advertising; impersonate any person or entity; upload viruses or malicious code; scrape or extract data using automated tools or bots; or bypass or interfere with any security or access-control measures we use. We may suspend or terminate your access at any time if we determine you've violated these Terms.
15. AI Agents
This section applies if you use, enable, or deploy an "Agent" — any software that takes autonomous or semi-autonomous action on your behalf without direct supervision — to access or interact with the Services.
Agents may only access the Services if they: (i) clearly identify themselves as an Agent in the user-agent string of every request (e.g., "Agent/[agent name]"); (ii) do not conceal that their activity is automated, including by mimicking human behavior or bypassing CAPTCHAs; (iii) respond truthfully if asked whether they are automated; and (iv) do not circumvent any measure we use to control Agent access. We may limit or block Agent access to the Services at any time, by technical or other means.
16. Termination
We may terminate this agreement or your access to the Services at any time, at our discretion and without notice. You'll remain responsible for any amounts due as of the termination date. Provisions that by their nature should survive termination — including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — will continue to apply.
17. Disclaimer of Warranties
Information on the Services is provided for general informational purposes only, and we don't warrant its accuracy or completeness. Reliance on it is at your own risk.
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER SERIOUSLY PIECEFUL NOR NODS GROUP LLC, NOR OUR OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR SERVICE PROVIDERS (INCLUDING SHOPIFY), WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR REPLACEMENT COSTS — ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM.
Nothing in this section limits any liability that cannot be limited under applicable law.
19. Indemnification
You agree to indemnify and hold harmless Seriously Pieceful, NODS Group LLC, Shopify, and our respective affiliates, officers, employees, and agents from any claims, damages, losses, or costs (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services — including any image you upload.
20. Severability
If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remainder of these Terms will remain in full effect.
21. Waiver; Entire Agreement
Our failure to enforce any right or provision of these Terms won't be considered a waiver of that right. These Terms, together with any policies we post (including our Privacy Policy), constitute the entire agreement between you and us regarding the Services, superseding any prior agreements or communications.
22. Assignment
You may not transfer or assign these Terms or your rights under them without our prior written consent. We may transfer or assign these Terms at any time without notice to you.
23. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your country of residence apply. You and Seriously Pieceful consent to the jurisdiction of the courts located in Wyoming for any dispute arising from these Terms.
24. Changes to These Terms
We may update these Terms at any time by posting the revised version on this page. The version in effect at the time you place an order applies to that order. Continued use of the Services after changes are posted means you accept the revised Terms.
